The implementation of a whistleblowing procedure - How to conduct an internal investigation ?

Once Draft Law N.7945, which aims to transpose into national law the EU Directive of 23 October 2019 on the protection of individuals who report breaches of EU law, is adopted, employers will have to set up internal reporting channels and procedures. We will therefore provide employers with a practical guide to react appropriately in the event of an alert and to comply with their obligations. Following the adoption on 16 April 2019 of the Directive on the protection of individuals reporting breaches of EU law, employers in all sectors will soon be required to implement a whistleblowing or speaking-out policy, as well as to set up internal reporting channels and procedures. The upcoming new law aims to protect individuals who reports breaches of EU law. Nevertheless, the successful implementation of a whistleblowing procedure in line with the legal requirements will also help to encourage disclosures at an early stage, enable concerns to be raised and appropriately addressed internally before they escalate, and cause, among others things, damage to the company’s reputation by spiralling negative communication which, through social media, reaches a very large number of people. After recalling the material and personal scope of this new legislation, we will help employers to adopt good practices and procedures for dealing with any alerts appropriately, in full compliance with their legal obligations. Objectives: - Understand the role and obligations of employers in case of whistleblowing - Identify the scope of whistleblower protection - Implement appropriate reporting procedures
